Secondary Transfer of Seminal Constituents

ABSTRACT

This paper reports a case of rape in which the forensic DNA analysis of a penile swab revealed a DNA mixture in the epithelial fraction consistent with the complainant and suspect, as well as the detection of spermatozoa from a second male in the sperm fraction. Subsequently the semen present on the penile swab was shown to match the DNA profile of the complainant's boyfriend. By considering the DNA results obtained in both the female and male fractions, the Court concluded that the suspect had sexual intercourse with the complainant and was guilty of rape. The case illustrates that secondary DNA transfer, i.e. the passing of DNA through an intermediary, can be important in solving crime.

RÉSUMÉ

Dans cet article, l'analyse génétique d'un écouvillon pénien d'une cause de viol a révélé la présence d'un profil génétique d'origine mixte dans la fraction épithéliale compatible avec la plaignante et le suspect ainsi que la présence d'un deuxième mâle dans la fraction spermatique. Des nouvelles analyses ont démontré que le profil génétique obtenu du sperme sur l'écouvillon pénien correspondait à celui du petit ami de la plaignante. En se basant sur les résultats des analyses génétiques, la Cour a conclu que le suspect avait eu une relation sexuelle avec la plaignante et était coupable de viol. Cette cause illustre que le transfert secondaire d'ADN (i.e. transfert de l'ADN par un intermédiaire) peut être un facteur important pour résoudre un crime.
