The Florida Property Rights Law

 

Abstract

Background

Article X, §6(2) of the Florida Constitution provides the legal basis for governmental exercise of eminent domain authority in Florida: “No private property shall be taken except for a public purpose and with full compensation therefor paid. …” Through eminent domain, physical possession and use of property are taken from a private owner and transferred to the public. The private party is compensated for the property loss.
