Does the Lafayette Case Bring Zoning under the Antitrust Laws?

 

Abstract

In 1962, the editors of Zoning Digest, as it was then called, published an article by a young assistant professor named Daniel Mandelker on the subject of Control of Competition as a Proper Purpose in Zoning, 14 ZD 33. For many years, it remained one of the few attempts to analyze an issue that goes to the philosophical heart of the zoning power.1
