Temporary Taking: Point and Counterpoint

 

Abstract

The taking issue can always be counted on for law review comments. And this decade's land use issue—temporary takings—has recently inspired two of the most interesting ones, which provide point and counterpoint on the issue. The two articles are Gus Bauman's The Supreme Court, Inverse Condemnation and the Fifth Amendment: Justice Brennan Confronts the Inevitable, 15 Rutgers L.J. 15 (1983) published in November 1984 and Norman Williams Jr., R. Marlin Smith, Charles Siemon, Daniel R. Mandelker, and Richard F. Babcock's The White River Junction Manifesto, 9 Vermont L. Rev. 193 (1984). (The authors of the latter article are referred to as “WSSMB” below.)
