State Impact Fee Legislation

 

Abstract

Recent surveys indicate that municipalities frequently rely on the use of fees imposed as conditions of development approval to finance off-site facilities to serve new develop-merit.1 The most common form of off-site development exaction is the fee in lieu of dedication requirements, typically found in local subdivision ordinances. Impact fees, however, are gaining popularity as the regulatory mechanism offering the greatest flexibility.
