Zoning Discrimination Against Group Homes under the Fair Housing Act

 

Abstract

Amendments to the Fair Housing Act in 1988 make the act applicable to discrimination against handicapped persons. Congress intended the amendments to cover discrimination in zoning ordinances, and practices that discriminate against group homes for handicapped persons are covered by the statute. The 1988 amendments also prohibit discrimination against families, a provision that may also affect zoning ordinances.
