The View from Belmont, Massachusetts

 

Abstract

Two recent decisions concerning the construction of a 69,000-square-foot temple by the Church of Jesus Christ of Latter-day Saints in Belmont, Massachusetts, should be examined together. The first is the U.S. Court of Appeals for the First Circuit decision in Boyajian v. Gatzunis 212 F.3d1, (1st Cir.), cert. denied 531 U.S. 1070 (2001) (it can be found at: http://laws.findlaw.com/1st/991230v2.html), and the second is the Martin decision by the Massachusetts Supreme Judicial Court, Martin v. Corporation of the Presiding Bishop, 747 N.E.2d 131 (Mass. 2001), 53 ZD XX.
