Abstract
The regulation of design, both in architecture and city planning, is not a new phenomenon. Although design guidelines have gained popularity in the US. over the last several decades, there are numerous examples of direct or indirect design regulation throughout the history of Western civilization. Current development patterns that are design-based have encouraged communities to adopt more detailed regulations than ever before. This article will examine the evolving legal foundation of design guidelines, look at common and creative challenges to aesthetic regulations, and explore the process of drafting guidelines that comply with the requirements of the law and good design.
