Libelous Language Post Lawrence: Accusations of Homosexuality as Defamation

Pages 55-72 | Published online: 17 Oct 2012

Abstract

Whether language has that tendency [to be defamatory] depends, among other factors, upon the temper of the times, the current of contemporary public opinion, with the result that words, harmless in one age, in one community, may be highly damaging to reputation at another time or in different place (Mencher v. Chesley 100).
