The future public funding of family dispute resolution services

Abstract

This article employs data gathered in the course of monitoring the Legal Services Commission's family mediation pilot in order to review the arrangements for public funding of lawyer and mediation services for separating couples and to review systems of case allocation between those services. The authors argue for a model ('finance by capitation, with gatekeepers') which is borrowed from health care and which has been fine-tuned in light of randomized controlled trials undertaken in the USA.
