Abstract

CIS/149/1989. C, aged 87, went to live in a nursing home owned by his daughter. The issue was whether he was entitled to the applicable amount prescribed for persons in such accommodation. C could not be so entitled if he came within the class of “persons to whom regulation 19 does not apply” in paragraph 14 of Schedule 4 to the Income Support (General) Regulations, which prescribed two alternative situations in which regulation 19 shall not apply. The first concerns the case where accommodation and meals, if any, of the claimant “are provided in whole or in part by a close relative.” Alternatively, a claimant in a nursing home does not receive the amount prescribed for such persons “where the accommodation and meals if any, are provided … other than on a commercial basis.”
