Abstract
R(U) 6/89. C, who was in receipt of unemployment benefit (U.B.) from March 11, 1985 to March 24, 1986, went abroad on holiday from June 14 to 28, 1985. Following that period of unemployment she worked for the M.S.C. for the maximum period of one year, and then reclaimed U.B.: Her claim was disallowed because her contributions for the year ending April 6. 1986 were deficient by reason of her absence abroad. The Commissioner, Dr. M.J. Goodman, held the tribunal was wrong to decide the question of C's entitlement to credits, that being a matter for the Secretary of State. On the assumption, however, that the contributions were deficient, the question arose whether the repeal of section 33(l)(a) of the Social Security Act (S.S.A.) 1975 from October 1, 1986 excluded entitlement at a reduced rate.
