Product liability-in the case of a licence

Product liability, tortious liability and even responsibility under criminal law constitute a rather new and difficult field created or, better said, only harmonized by the EU Product Liability Directive. There are still further critical points which should be considered. A general overview is presented and it is emphasized that this aspect challenges licensors and licensees to take even more care when drafting their respective agreements.
