Climate Change Litigation and Policy—A Rapidly Shifting Landscape

Abstract

Timothy Dowling and Jennifer Bradley's commentary in the August 2007 issue of Planning & Environmental Law discussed the significance of the U.S. Supreme Court's ruling in Massachusetts v. EPA, which had just been issued four months earlier. I shared some of the state and local initiatives occurring in response to the rapidly growing appreciation of the consequences of climate change. A year has passed and it is fair to say that not much progress has been made at the federal level. Fortunately, state and local governments are bubbling with new approaches to climate change mitigation.
