Abstract
The Religious Land Use and Institutionalized Persons Act (RLUIPA) is unconstitutional as well as unfair and should be struck down by the courts. This commentary will discuss the constitutional principles that invalidate RLUIPA, which covers both land use and prison regulations. The focus of this commentary will be on its land use side.
