In the Offing: A More Stringent Standard of Review

 

Abstract

The U.S. Supreme Court's eminent domain decision on June 23 in the Kelo case, which upheld the City of New London's use of eminent domain to take the homes of Susette Kelo and other homeowners to implement an economic development plan, has evoked a nationwide backlash that has not been seen in response to a Supreme Court land use decision in many years.
