Development Impact Fees 2006: A Year in Review

Abstract

A number of significant impact fee cases were decided in 2006 and new legislation was adopted in Florida, a state with a long history with “common law” impact fees. While the cases turned significantly on state law grounds, they are important to anyone who practices in the area. First, impact fees increasingly are becoming an indispensable source of revenue for communities struggling to provide infrastructure to new growth. As communities' reliance on this source of funding becomes more critical, several things have happened.
