Resumen

La ley de responsabilidad penal de los menores tiene como objetivo que el menor asuma la responsabilidad de sus actos y se comprometa con un cambio personal. Este trabajo pretende conocer la valoración que hacen los menores infractores de los efectos que tienen en ellos las medidas judiciales que están cumpliendo. Se entrevistó a una muestra de 102 menores que cumplían medidas judiciales, tanto de libertad vigilada como de internamiento, en la Comunidad Autónoma de Canarias. A través del análisis de contenido se hallaron seis categorías diferentes que van desde percibir la medida como un castigo que no les va a servir para nada, hasta verla como una oportunidad de cambio personal. Se concluye que hay una gran variabilidad entre los menores infractores a la hora de valorar los efectos educativos de la medida, y que es posible lograr los objetivos incluso con aquellos que cumplen medidas de internamiento y/o son reincidentes. Se propone utilizar la opinión de los propios menores como un indicador procesual de la eficacia de las medidas impuestas.

Abstract

Spanish young offenders' law is aimed at getting young offenders to take responsibility for their acts and to commit themselves to changing their personal behaviour. This study attempts to find out young offenders' evaluation of the effects of the judicial measures that they are undergoing. We interviewed a sample of 102 minors who were complying with judicial measures, either on probation or in custody in the Autonomous Region of the Canary Islands. Following the analysis of results, six distinct categories were found that range from perceiving the measure as a punishment that does not serve any purpose to seeing it as an opportunity for personal change. We conclude that there is a great variability among young offenders when it comes to evaluating the educational effects of measures, and that it is possible to achieve the measure's objectives, even for those who are serving custodial measures or are re-offenders. We propose using the evaluation of the minors themselves as a procedural indicator of the efficiency of the measures imposed.
