Relations between landowners and mining concessionaries in countries with a highly developed mining industry: how can legislation help both sides' interests?

Abstract

In some Andean countries competitive land-uses are emerging that challenge the historical precedence of mining over other forms of economic activity. The legal mechanisms that regulate access by mining titleholders to private and state-owned lands in Bolivia, Chile and Peru are compared and an attempt is then made to determine the most suitable legal mechanism for Peru to adopt to assure rights of surface access for mining companies.
