DES RIVES SAINES POUR UN FLEUVE SAIN

Abstract

Taking for granted that the quality of the St. Lawrence River depends to a large extent on the state of its banks, it follows that the latter must be given adequate protection. The means at our disposal to ensure such protection fall into three main categories, that is, reserves, land development and the granting of public lands. This paper presents a land development technique which offers a particularly interesting possibility from the point of view of conservation and development of the river’s banks, namely that of the "natural district". After giving a clear definition of encroachment, the authors discuss the advantage of using the Cultural Property Act (Statutes of Quebec, 1972, chapter 19) relating to historic and natural districts.

Etant acquis que la qualité du fleuve Saint-Laurent dépend fortement de l’état de ses berges, il faut assurer à ces dernières une protection adéquate. Parmi les instruments de protection des berges, on retrouve trois catégories principales : les réserves, les techniques d’aménagement du territoire et les concessions de terres publiques. Cette étude présente une technique d’aménagement foncier qui offre des possibilités particulièrement intéressantes du point de vue préservation et mise en valeur des rives du fleuve, soit celle de "l’arrondissement naturel". Après avoir précisé la notion même d’empiétement, les auteurs discutent l’intérêt d’utiliser la Loi sur les biens culturels (Lois du Québec, 1972, chapitre 19) en ce qui a trait aux arrondissements historiques et naturels.
