INDIAN RESERVE BOUNDARIES AND RIGHTS: ENFORCEMENT ON THE ST. LAWRENCE RIVER

Abstract

The St. Regis Reserve is located on the St. Lawrence Seaway near Cornwall, Ontario. The problems of jurisdiction are not new to the Mohawk people, because Canada and the United States both lay claim to reserve lands which are artificially divided among Ontario, Quebec and New York State.The Mohawk Nation is a sovereign people who command rights over the water and lands of the St. Lawrence basin, due to ancestral, cultural and religious occupation before the arrival of the non-Indian race.St. Regis Indians have never surrendered, ceded or otherwise sold these lands to any jurisdiction or government. However, the encroachment of the Canadian and U.S. governments on our sovereign lands has seriously affected our way of life. The St. Lawrence Seaway, industrial pollution, the illegal implementation of game and fish laws, and other covert acts of government are destroying a once-prosperous people. We cannot stand by and allow this to happen.

La reserve St-Regis est située sur la voie maritime du Saint-Laurent près de Cornwall en Ontario. Le peuple Mohawk connaît bien les problèmes de juridiction puisque le Canada aussi bien que les Etats-Unis réclament nos terres. La réserve est divisée artificiellement entre l’Ontario, le Quebec et l’état de New York.Le peuple Mohawk est un peuple souverain qui proclame ses droits sur les eaux et les terres du bassin du Saint-Laurent, en raison de sa présence ancestrale, culturelle et religieuse établie bien avant l’arrivée de races autres que la race indienne.Nous n’avons jamais rendu, cédé ou encore vendu ces terres a un gouvernement juridictionnel quelconque. Néanmoins, l’empiétement des gouvernements canadien et américain sur nos terres souveraines a sérieusement affecté notre mode de vie. La voie maritime du Saint-Laurent, la pollution industrielle, la mise en vigueur illégale de lois sur la pêche et la chasse ainsi que d’autres lois secrètes de ce gouvernement sont en train de détruire un peuple qui a connu autrefois la prospérité. Nous ne pouvons demeurer passifs devant une telle situation.
