LES CONSEQUENCES POUR LE QUEBEC DU TRAITE DES EAUX LIMITROPHES : PLAN DE REGULATION DU LAC ONTARIO

Abstract

When the St. Lawrence Seaway and the control works at the Lake Ontario outlet were being developed, the International Joint Commission in virtue of the Boundary Waters Treaty established guidelines according to which the flow of Lake Ontario was to be regulated and set up a management agency called the International St. Lawrence River Board of Control which was to ensure that these guidelines would be followed.The author comments on the positive as well as the negative consequences of the implementation of the Lake Ontario regulation plan as far as Quebec interests are concerned, especially those related to riparians and to energy production. He also considers the consequences, in the future, of the increasing pressures aiming at a greater reduction of the fluctuation of the Great Lakes water levels.

Lors de l’aménagement de la Voie maritime du Saint-Laurent et des ouvrages de contrôle à la sortie du lac Ontario, la Commission mixte internationale, en application du Traité des eaux limitrophes, a établi les critères selon lesquels doit être réglé le débit du lac Ontario et a mis sur pied un organisme de gestion, le Bureau international de contrôle du Saint-Laurent qu’il a chargé de voir à l’application de ces critères.L’auteur se propose d’examiner les conséquences positives et négatives de la mise en oeuvre du plan de régulation du lac Ontario pour les divers intérêts québécois, en particulier ceux relatifs aux riverains et à la production d’énergie. Il s’interroge aussi sur les conséquences pour l’avenir de la montée croissante des pressions visant à réduire davantage la marge de variation des niveaux des Grands Lacs.
