JURISDICTIONAL PROBLEMS IN THE HADEJIA/JAMAARE RIVER BASINS OF WEST AFRICA

Abstract

This paper discusses the legal problems arising out of a proposal to control two rivers in northeast Nigeria for irrigation purposes. River control could have effects on the lower reaches of the river where it forms an international boundary and on the conditions in Lake Chad. Lake Chad is bordered by four countries and changes in the Lake could affect the lives of the citizens in all four countries.In addition to the international problems, there are legal problems arising from the rights and powers of different states within the federal Republic of Nigeria.

Ce document discute des problèmes légaux gui découlent d’une proposition visant à contrôler deux rivières situées dans le nord-est du Nigeria aux fins d’irrigation. Le contrôle de ces cours d’eau pourrait affecter les biefs inférieurs de la rivière où celle-ci dessine une frontière internationale ainsi que les conditions du lac Tchad. Le lac Tchad est borné par quatre pays et des variations dans le lac pourraient affecter la vie des citoyens de ces quatre pays.En sus des problèmes internationaux, on a connu des problèmes légaux découlant des droits et des pouvoirs des divers états à l’intérieur de la République fédérale du Nigeria.
