GESTION DU LIT DES COURS D’EAU ET LACS AU QUEBEC

Abstract

This paper gives an outlook on the actions taken by Quebec Ministry of Natural Resources in order to manage properly the banks and bottoms of watercourses of the public domain under provincial jurisdiction. The author mentions the various elements to be considered in studies pertaining to the depermination of riparian ownership rights on rivers. Finally the author summarizes the various types of physical actions and works that can be authorized in the beds of rivers and lakes, the nature of title-deeds that can be granted to riparian owners and the elements to be considered in fixing the annual rent for riparian lots in deep waters.

Cet article donne un aperçu des interventions du ministère des Richesses naturelles du Québec au niveau de la gestion du lit des cours d’eau du domaine public sous juridiction provinciale. L’auteur énumère les éléments à considérer dans le cadre des études visant à déterminer les droits de propriété des cours d’eau. Enfin, il résume les types d’intervention qui peuvent être autorisés sur le lit des cours d’eau, la nature des titres qui peuvent être consentis et les éléments à tenir compte dans l’établissement des loyers annuels pour la location de lot de grève et en eau profonde.
