Water Rights Law and Water Shortages in Western Canada

Abstract

The author describes in outline the law that has governed the distribution of rights to consume water in Western Canada from the time of agricultural settlement to the present day and examines its major defects. He concludes that the law provided a good method of initially allocating water rights but that it is too rigid, except to some extent in British Columbia, to accommodate new uses of water in basins that are fully allocated and that it discourages the conservation of water supplies. Saskatchewan’s response to these defects in the form of the Saskatchewan Water Corporation Act is considered and criticized. The author then suggests a solution to the problems of the existing legislation which would allow the transfer of water rights subject to a number of safeguards.

L’auteur donne un aperçu de la loi qui, depuis l’époque de la colonisation agricole jusqu’à nos jours, régit la distribution des droits d’usage de l’eau dans l’Ouest canadien et il en examine les principales lacunes. Cette loi qui, au départ, représentait une bonne méthode de répartition est maintenant trop rigide pour s’adapter aux nouvelles utilisations de l’eau des bassins déjà affectée à certains usages (exception faite de la Colombie-Britannique), et elle décourages les efforts de conservation. Pour contrer ces difficultés, la Saskatchewan a promulgué le "Water Corporation Act", lequel fait l’objet de nombreuses critiques. L’auteur propose une solution aux problèmes causés par la législation actuelle qui favoriserait le transfert des droits d’usage de l’eau moyennant certaines garanties.
