Law and the Management of the Great Lakes Basin

Abstract

The article provides an overview of the legal context for water management in the Great Lakes basin (Endnote 1). To this end, it examines three types of legal regime that operate in the basin: international law, including both conventional and customary obligations, Canadian domestic law, and U.S. domestic law. While one can see the emergence of certain common principles across jurisdictions, there has yet to develop a fully consistent approach to water law and policy in the basin. One can, however, point to an impressive history of cooperation in the region, although this cooperative approach will continue to be tested with the emergence of new challenges such as climate change.

L’article donne un aperçu du context juridique de la gestion de l’eau dans le bassin des Grands Lacs. À cette fin, il examine trois types de régimes juridiques s’appliquant au bassin : le droit international, y compris les obligations issues du droit coutumier et du droit conventionnel, le droit interne du Canada et celui des États-Unis. Même si l’émergence de certains principes communs est perceptible au sein des gouvernements, il reste encore à élaborer une approche entièrement cohérente à l’égard du droit et des politiques hydriques dans le bassin. On peut cependant souligner le bilan impressionnant de la région dans le domaine de la coopération, bien que les nouveaux défis qui surgissent, dont le changement climatique, continueront de mettre à l’épreuve ce sens de coopération.
