Abstract

This explores a case where plaintiff’s daughter passed away after being hospitalized two weeks after an accident at the Margaret Clark Aquatic/Adaptive Center which was owned and operated by the Brownsville Independent School District (BISD). The incident occurred while the deceased was participating in an Adapted Physical Education (APE) aquatics program offered at the Aquatic Center. The Aquatic Center had been offering the APE program for many years and the deceased had been participating in the program since grade school.
