Ontario conservation authorities – end, evolve, interlude or epiphany?

Abstract

Ontario Conservation Authorities (CAs) were established in 1946 as a partnership between the Ontario provincial government and municipalities. Initially, their purpose was to apply a catchment or watershed approach to provide services and programs to reduce risk from flooding and erosion through an integrated approach to water and land management. In 2021, there are 36 Conservation Authorities. We consider key changes the Ontario Government has initiated or will be initiating related to CAs which are: (1) The relevant provincial Minister will have authority to approve specific development proposals or for an entire class of permits for a specified period of time in areas within CAs, even if the CAs oppose such development because the proposals involve areas vulnerable to flooding or other related hazards; and (2) Applicants for development permits will be able to appeal directly to the Provincial Minister and also the Local Planning Appeal Tribunal (LPAT) if their application is turned down by the Hearing Board of the relevant CA. This commentary describes key issues that have been historically noted as ‘problematic’ for previous and the current Provincial Governments, and shares information and insight on those matters. The conclusion considers whether the changes represent an end, an evolution, an interlude (an intervening period, an opportunity to recalibrate or refocus) or an epiphany (a moment of insight or understanding), or some combination thereof, for the CAs.

Abstrait

Les Autorités de Conservation (AC) de l'Ontario ont été établies en 1946 dans le cadre d'un partenariat entre le gouvernement provincial de l'Ontario et les municipalités. Au départ, leur objectif était d'appliquer une approche fondée sur les bassins versants afin de fournir des services et des programmes visant à réduire les risques d'inondation et d'érosion grâce à une approche intégrée de la gestion de l'eau et des terres. En 2021, il y 36 bureaux de protection de la nature. Nous tenons compte des principaux changements que le gouvernement de l'Ontario a entrepris ou qu'il entreprendra en ce qui concerne les AC qui sont : (1) le ministre provincial concerné aura le pouvoir d'approuver des propositions d'aménagement particuliéres ou pour une catégorie entière de permis pour une période de temps déterminée dans des zones situées dans les AC, même si les AC s'opposent à un tel aménagement parce que les propositions concernent des zones vulnérables aux inondations ou à d'autres dangers connexes; et : (2) les demandeurs de permis d'aménagement pourront appeler directement auprès du ministre provincial et du Tribunal d'appel de l'aménagement local (TAAL) si leur demande est refusée par la Commission d'audience de l'AC concernée. Le présent commentaire décrit les principaux enjeux qui ont toujours été notés comme «problématiques» pour les gouvernements provinciaux précédents et actuels, et partage l'information et les points de vue sur ces questions. La conclusion considère si les changements représentent une fin, une évolution, un intermède (une période intermédiaire, une occasion de recalibrer ou de recentrer) ou une épiphanie (un moment de perspicacité ou de compréhension), ou une combinaison des deux, pour les AC.
