The Regulation of Indecent but Nonobscene Computer-Mediated Expression and the First Amendment

Pages 34-56 | Published online: 21 Dec 2012

Abstract

The regulation of indecent but nonobscene expression on the Internet raises traditional First Amendment concerns about restrictions on content, but also adds new wrinkles to debates about community standards, jurisdiction, media convergence, and public vs. private mediated communication. These issues remain immensely important as boundaries on expression in this global medium are being worked out.
