The diversion of the mentally disordered: Some problems for criminal justice, penology and health care

Abstract

The diversion of the mentally disordered from the criminal justice and penal systems needs to be seen against the background of the management of the mentally disordered in general and of mentally disordered offenders in particular. The implications of diversion are discussed with special reference to the future of prison and prison medical services. Some jurisprudential issues are raised for further debate.
