1 See Devon W. Carbado and Mito Gulati (Citation2001) for an intriguing discussion of legal theories about employment discrimination and potential penalties for not fitting in at work. They argue that courts not only need to understand the dynamic “intersectionality” of plaintiffs' identity (race, gender, sexual orientation, and more) but also need to understand that how one presents one's identity is important to one's vulnerability to discrimination.
