1. In a rehearing on August 7th, 2007, after this editorial was written, the same court overturned their earlier ruling. The August 7th ruling held that terminally ill patients do not have a constitutional right to be treated with experimental drugs, even if they will likely die before the medicine is approved. In spite of this recent ruling, the moral issue remains and the debate will likely continue.
