Land governance and megacity projects in Lagos, Nigeria: the case of Lekki Free Trade Zone

ABSTRACT

This paper considers the land-governance (acquisition, compensation and resettlement) and physical planning (planning permits, development-control mechanism and environmental-impact assessment) processes surrounding Lekki Free Trade Zone (LFTZ) in Lagos, Nigeria, and the effects of the LFTZ on the lives and livelihoods of the inhabitants of indigenous communities affected by the project. The study revealed significant gaps in the payment of compensation and resettlement arrangements, leaving many residents economically vulnerable, and significant gaps in the Nigeria Export Processing Zones Authority (NEPZA) Act, which emphasizes economic development in free-trade zones, without consideration of the social and environmental consequences. A more balanced approach to the megacity’s development is proposed, incorporating social and environmental considerations alongside economic objectives.

尼日利亚拉各斯土地治理与超大城市项目：莱基自由贸易区案例分析. Area Development and Policy. 本文探讨了拉各斯莱基自由贸易区的相关土地治理（征收、补偿及重新安置）和实体规划（规划许可、开发控制机制及环境影响评估）过程，以及该自由贸易区对工程所涉及的原住社区居民生活和生计上的影响。本研究揭示了补偿给付和重新安置方面存在的显著差距致使许多居民落入经济脆弱境地，以及尼日利亚出口加工区管理局法案中存在着明显缺陷，缺少对社会及环境影响方面的考虑。针对这些问题，本文提出了一种对于推进该超大城市发展更兼顾经济目标及社会、环境考虑的新方法。

RESUMEN

Gestión del suelo y proyectos de megaciudades en Lagos, Nigeria: el caso de la FTZ de Lekki. Area Development and Policy. En este artículo se consideran los procesos de la gestión del suelo (adquisición, compensación y reasentamiento) y la planificación física (permisos de planificación, mecanismo del control de desarrollo, y la valoración del impacto medioambiental) en torno a la FTZ (zona de libre comercio) de Lekki, Lagos, y los efectos de la FTZ en la vida y subsistencia de los habitantes de comunidades indígenas afectadas por este proyecto. En el estudio se observaron lagunas significativas en el pago de indemnizaciones y los acuerdos de reasentamiento, dejando a muchos residentes económicamente vulnerables, y brechas considerables en la ley NEPZA, que da prioridad al desarrollo económico en las zonas de libre comercio sin considerar las consecuencias sociales y medioambientales. Aquí se propone un enfoque más equilibrado para el desarrollo de megaciudades, incorporando consideraciones sociales y medioambientales además de objetivos económicos.

Управление земельными ресурсами и мегагородские проекты в Лагосе, Нигерия: кейс ЗСТ Лекки. Area Development and Policy. В статье рассматриваются процессы управления земельными ресурсами (приобретение, компенсация и переселение) и физического планирования (разрешения на планирование, механизм контроля за развитием и оценка воздействия на окружающую среду) в окрестностях зоны свободной торговли в Лекки (LFTZ), Лагос, а также последствия LFTZ для жизни и быта местных общин, затронутых проектом. Исследование выявило значительные пробелы в выплате компенсаций и в порядке переселения, оставляющих многих жителей экономически уязвимыми, а также значительные пробелы в законодательстве, нацеленном на экономическое развитие в зоне свободной торговли без учета социальных и экологических последствий. Целесообразен более сбалансированный подход к развитию мегагорода, учитывающий социальные и экологические факторы наряду с экономическими целями.
