- There had already been judicial dissatisfaction with the state of the law long before this. In Re Citro, Hoffmahn J at first instance and Sir George Waller in the Court of Appeal held in favour of the wives in the case, stating that there were 'exceptional circumstances', which justified a postponement of the order for sale.
