It could be argued that chief justices may assign individuals with noted expertise in certain areas. Of course, measurement of 'expertise' is problematic since it is typically derived from authorship of noted opinions in particular areas. Such expertise is controlled by the Chief Justice's assignment of an individual judge to a panel addressing that issue in the first place.
