The Health Care Quality Improvement Act of 1986, which went into effect in 1990, requires state authorities responsible for licensing health care practitioners to report all licensure disciplinary actions to the National Practitioners Data Bank. This data bank allows hospitals and other groups to evaluate the credentials of applicants seeking hospital or other privileges. The law also requires insurance companies and some professional societies (currently only medical and dental societies) to communicate actions taken regarding a practitioner's professional competence or conduct. The American Professional Agency, a major provider of malpractice insurance for psychologists, now submits information to the Data Bank on all practitioners for whom they have made a payment as a result of a malpractice claim or judgement.
