National perspectives on managing transboundary environmental Hazards: The U.S.‐Mexico Border Region

Notes

  • The United States’ National Environmental Policy Act (NEPA) became law in 1969. Along with subsidiary legislation addressing air and water quality, it stands as the basic statutory framework governing environmental regulation in the United States. Protection of the environment in Mexico is both a function of constitution and statute. Reference is made to the obligation “to prevent and combat contamination” in Article 73 of the Mexican Constitution. A far reaching environmental law modeled on NEPA was enacted in 1971, and upgraded in 1982 and, subsequently, in 1988. For commentary on Mexican environmental regulations

  • Reports on toxic waste dumping in the New River, which flows from Mexicali, Baja California into Imperial Valley cities in California identify materials derivative of a manufacturing process transferred from B.F. Goodrich of Akron, Ohio to Química Orgánica through Policy (or CYDSA, its parent company) in which B.F. Goodrich owns a reported forty percent interest. The director of Química Orgánica said that “Goodrich never informed Química Orgánica that the substances might be harmful to health.” The response from a B.F. Goodrich official said “they are aware the chemicals may be dangerous and that they did issue proper precautions on handling the chemicals, but emphasized that Química Orgánica never asked Goodrich for assistance on environmental matters.”
